Legal Question in Medical Malpractice in India

Can a person with no medical qualification serve as a doctor in a hospital and attend to patients like a doctor?

and

If a person has not a severe problem and the doctor still urges the patient to get admitted and on refusing if he threatens that in future if something bad happens they would not be responsible,then is an action possible on this to take?
