Legal Question in Real Estate Law in India

Buying a flat in building constructed by society on plot allotted to them on lease basis by Mhada. do i need to get Mhada transfer.?? I heard that it is no more required. but the Bank whom i am approaching for loan is asking for it. The building is 9 yrs old. The seller is original member of Society. Sale Agreement registration & stamp duty is executed only bank loan amount is pending.

Dear Sir / Madam,

Since the construction of the building and allotment of flats to members is done by the Society, there is no question of getting MHADA approval for the transfer, as MHADA is in no way concerned or involved.

Check term of allotment / lease by MAHADA to Society and act accordingly.

If term of allotment / lease required permission or NOC of MAHADA, then same may be obtained.
