Legal Question in Real Estate Law in India

Dear Sir,

We are trying to buy a land in Chennai which is a patta land for that we have gone for housing loan combined ( land purchase and construction of house) after scrutinizing the documents bank lawyer asked for the original sale deed which was created on 1953. But the seller doesn�t have the original document he lost the same long back but he is having the copy of document. Hence the bank declined to offer the loan, Now I went to check the same with other lawyer what he is saying 30 years document is sufficient to buy a land so u can proceed to buy, if u need further safety you can put a advertisement in a daily paper mentioning the survey number and other detail of the land for objection and wait for seven days if you didn�t get any objection then u can buy.

Can you please help me is it ok to buy or not to buy? Because we have given 80% of our own money as advance to the seller.

Please help me ASAP.

Dear K Saravanan,

You can get the entire chain of documents of the land from the Tehsildar / District Registrar which you can furnish to the bank. You can buy the property if you do not need to depend on the bank loan for the remaining 20%.
