Legal Question in Real Estate Law in India

Hi,

my grandmother who had 6 children expired 11 years ago and since then my aunty who is a divorce has been living there alone. she is not allowing us to sell the flat as other children wants their share. The condition of the house has become worse as she is unable to maintain it.....i have 3 queries:

1- how can we sell the flat? other 5 children want to sell the flat as we are in need of money

2- one of the shareholders stays abroad. does he needs to fly all the way to india to sign the papers or can there be any alternate way?

3- current condition of the flat is very bad. it requires a huge amount to repair it. as per the islamic law, should the repairing cost be equally divided amongst all children or should the 2 guys pay double?

According to your queries seem you are Muslim, law in concern says you and other hire can sell their share in the property by declaring such right over the property.

The person living out need not be come here to sell the property there are provisions in law.

No any laws in Islam regarding sharing of amount to repair house.
