Legal Question in Real Estate Law in India

I purchased two properties from a builder/developer. I got letter of allotment for both from the company on letter head.

One property was completed and rented back to developer for running a resort. After five years the developer quietly closed shop selling the property to someone else.

The other property has been transferred to some other developer without my knowledge.

I filed a criminal case in district court and now a criminal Review Petition. It has come up for conciliation in HC.

Is it a criminal or civil matter?

What is legal remedy available to me?

When you filed a criminal case, how could it be civil? But even such matter can be referred to mediation by the court. On the mediation table, put up your terms and conditions. If he does not accept that, mediation will probably fail and case will resume. But since you are in review now, it seems lower court has dismissed your case. Therefore, I suggest you to prepare accordingly this time. You should have filed the suit or approach the consumer forum as well. Lots of remedies are available.
