R/s sir,

I have own a 2 bhk flat(Kurla,Mumbai) with wife joint name.I would like to purchase MHADA flat.As having one flat in Mumbai i can not purchase another flat.Please advice me with whose name i can purchase flat legally.Can i purchase flat with fathers name as stating i m gifting the same flat to them.My fathers age 72 years.

Or advice me with with whom name i can purchase it.

Dear Sir / Madam,

An individual can own more than one flat in Mumbai since there is no restriction. Secondly, if you are the first named flat holder in the present flat and your wife is the second named holder, in the new flat your wife can be the first holder and you can remain the second holder. Taking a flat in the name of your father is neither advisable nor recommended since all the legal heirs can claim a share if it is in the name of your father.
