Legal Question in Real Estate Law in India
In a sale agreement wherein it is mentioned that the sale should be completed within 6 months and when the buyer did not come for the sale, what is the legal option? In the agreement it is clearly mentioned that if the buyer did not settle the balance amount within 6 months, then the agreement stands cancelled automatically and also he forfeits the advance amount paid. If so can the seller sell his property to another person? If so should he legally intimate the earlier prospective buyer? Or he can just go ahead and sell the property to another person? Pl answer in detail if time permits.
