Legal Question in Real Estate Law in India

I am a seafarer employed in shipping industry (Merchant Navy) therefore I executed and gave my power of attorney to my wife in order to facilitate sale & purchase of my property & real estate. There has been a dispute in sale of agricultural land jointly owned by me, my real brother and two of my real uncles (the land was sold in consultation with me) however the deal was not matured due to various reasons and now the purchaser has filed a case as he wants the deal to be dissolved and claiming back the token money he paid to all the sellers. Since my wife is not able to attend the court hearing can I make some sort of legal undertaking wherein I can indemnify my wife and take whole responsibility of further course of actions and follow up including appearing in the court for legal proceedings as and when required.

Your wife was only your attorney meaning thereby she was acting at your behalf so it is you who is to be made party in the case and not your wife. In civil case defendants are not required to be present in court on each date except on some important dates. If require consult with details. Sidharth 9811776422
