my father have signed a gift deed in favour of my brother then is it necessary to relinguish my right to a immovable property and if there is any problem later on can i challanged a gift deed

Dear Sir

If the property is self acquired property of your Father, then he can execute a registered gift deed in favor of your brother, No need for you to execute any deed to relinquish you right in the property. Also, you cannot challenge the gift deed on merits.

However, if the property held by your father is ancestral property, then he cannot gift the entire property, save his share in the said property. In such event, it is necessary for you to execute a relinquishment deed to waive your right in the property, otherwise, in future you can certainly challenge such gift deed on the ground of lawful authority of your father to gift such property.
