You have not provided nearly enough information to answer; some of the other factors required are whether or not there was an earlier spouse, and if so was there a divorce? If there was, then what were its terms and have they been complied with? Are there children of any relationship? Was there a cohabitation agreement? These are just the most common questins that have to be answered; as a lawyer receives answers, it will lead t more questions that must be answered before any answer can be definitively given. Then the lawye must apply the law as found in the Estate Administration Act of B.C., and possible the law as found in other BC statutes as well, depending on the information given. Please see a lawyer.
