Legal Question in Wills and Trusts in India
I am eldest son of my expired father,my mother & young brother is alive,I had made monetry contribution to construct our building.My young brother instigated my late father to make the will with the entire building property.The will was made in the year 2001.There is no any specific time of effecting the will.And there have no any nomited executor of will.Now it almost 13 years the will have made.Please advice me how can I get my share of building property as I have no any other alternative.

Dear Sir / Madam,
The Will needs to be Probated by the Court to take effect in terms of transfer of title of the property in the name of your brother. When you receive intimation of the Probate from the Court, you should contest the Will. If the Will is incomplete or invali, you should get the property transferred in your mother's name and get your mother to Will or Gift it equally to you and your brother.
