My father died intestate leaving an immovable property. We are three brothers who are equally entitled to the property.

Dear Sir,

I've already said it several times, I'm saying it again - If your father died intestate leaving behind an immoveable property, the title of that immoveable property vests only in your mother. You and your brothers' entitlement rights on the property do not arise as long as your mother is living. You should check with the Tehsildar / District Registrar whether the Succession Certificate is necessary to transfer the title of the property in the name of your mother and the prevailing procedure that needs to be completed. A Succession Certificate is issued by the Court within 6 (six) months from the date of application to the Court thereof.
