Legal Question in Wills and Trusts in Trinidad and Tobago

Goodday, my dad passed away and did not leave a will. My mother was still married to my father even though they have been seperated for over 15yrs and she has a child for her new spouse. My sister would like to apply for letters of administration. I would like to know who would be the rightful person to apply for letters of administration for my father.

Your mom is still the legal spouse and the person entitled to apply for the estate of her deceased husband. Your dad had the opportunity to apply for and obtain a divorce but he did not. In addition he did not leave a will.

In the absence of those positive acts from your dad the law shall be applied.
