Chapter 13 Bankruptcy and Child Support

Is it true, there is pending a new ruling (either Alabama or Federal), where the debtor who owes child support can attempt to zero out that debt IF collection for the child support is enforced through a third party. For Example, National Child Support Network.

If this is true, how do I protect my right to receive the payment of overdue child support, collection through the courts or state social services have never worked in the past 15 years. Therefore, a third party collection agent, for a fee, is the ONLY option that remains.

I am not aware of any such rule in Utah. The courts have been very supportive here of enforcing child support payment obligations.

The law is not all powerful nor effective in all instances, such as what you imply in your message. Too often those who are without character and honor escape their legal and moral obligations.
