Legal Question in Bankruptcy in Alabama

Summons in an adversary proceeding

I am an investor that purchaed a property that was in foreclosure in AL. The company that brougth me to the table said that they had worked it out with the owner that she would give up all the proceeds that were in the house, and continue to rent it from me.

She did this, by signing her proceeds check over to this company and then she filed for Chapter 7. I am now being sued by the Bankruptcy court and they are preventing me from selling the house. The tent has moved out and I need to sale it.

What are my options?

You are being sued, so that means only on thing - you need to get a lawyer, well in advance of the deadline for filing an answer. Since no one here even knows the most basic facts, much less the claims in the complaint, there is no way to speculate on your options. Your lawyer will advise you on what to do.

The post by Scott Riddle is on point. GET A LAWYER NOW. The Bankruptcy Trustee is going to try to "undo" the sale in order to get funds from the house for the unsecured creditors. You did not state from what Bankruptcy Court you have received your AP notice. You should find an attorney who practices in the bankruptcy court in which you are being sued.
