Legal Question in Business Law in Alabama

My partner is stealing my half of our business

Two years ago I was asked by a guy to consolidate my web site with his. We wanted to go after the larger sites and felt we could do so if we combined forces. We did and since have become one of the top 3 sites in our category.

Since the merger I have sunk about 10K into the site of my own money and him about equal not including two years of my life. Back in Feb. of 2004 I lost my full time job and had to move. Over the next 3 months I was unable to be there every day to assist with any maintenance of the site. My partner late last year also had to disappear for awhile because of heart surgery and I picked up the slack.

Well after 3 months it appeard that I was not going to be able to get back involved on a day to day basis as I had been so I offered my partner the buy me out of my portion. He would never respond to any efforts to contact him. He since hired an outside consultant to redirect the domain away from my control and completly locked me out of all aspect of the site/business. Repeated attempts to get him to respond to me via email have failed and I am lost at what my legal recourse is.

Now there is NO partnership agreement between us on paper as I tried to get him to sign one about a year ago and he never did.

Well, even though there is no partnership agreement in writing, you are still partners and both liable for partnership business as well as entitled to partnership assets. Was there a verbal contract as to what happened if the partnership dissolved? If so, there is a contract.

You could probably file an action in court to recover your money.
