my husband payroll is about to be deducted from a voluntary repo and we don't have the car anymore we are tipping on the brink of poverty we need help

Well, the bad part is that you signed a note when you purchased the vehicle. Whether or not the vehicle is still in your possession is not an issue. The lender is enforcing its rights against you under the terms of the promissory note, whereby you and/or your husband promised to make X number of payments for X number of months. You do have rights, though, and you need to act immediately to protect your assets from further collection efforts by the creditor/lender. It appears, from your zipcode, that you reside in the Mobile/Baldwin County area. I would urge you to call your local bar association and ask for a referral to a local attorney who practices in this area. Good luck.
