Legal Question in Credit and Debt Law in Alabama

I have a judgment agreement with a collection agency, to pay $300.00 a month for credit card debt. But have been unemployed for 1 1/2 years due to injury. I have been sending them $50.00 a month for the past year, but now they refuse to accept that amount. Can they take me to court for defaulting? And what are my options?

I would need to know more before fully answering your inquiry. The short answer is yes...if you default on this agreement, then they, the creditor, can move the court for an order that would allow execute on their judgment, e.g. levy on a bank account, garnish wages, place a lien on the residence, etc. You need to take action to protect yourself immediately. You do have options. Feel free to call my office, 205.939.0780, if you want to set up a free consultation. Thank you.
