Legal Question in Credit and Debt Law in Alabama

Judgments & executions

my wife has about 10 lawsuits all of which will get a judgment. She lost her buisness but we had already filed bankruptcy. We don't own a house and I own the only car in my name only. Can they get an execution against things I own in the house since I am not named in the suit? Can they take my car? Can they take my furniture since she lives there?

Re: Judgments & executions

Did you include the lawsuits in the bankruptcy? If you did, they probably should not be going forward.

Also, if you are being sued by debt buyers (i.e. not the original creditor) then you might want to read some of our blog posts about these types of suits.

Normally a judgment creditor can not take property of someone not in the suit - but they may well be able to put a lien on the house and in some situations will try to force a "sheriff's sale" of the house.

Feel free to contact us to discuss these lawsuits in more detail. Email us with a time to call you.
