Legal Question in Credit and Debt Law in Alabama

Loan not repaid...

A co-worker went out of the states and ''got stranded'' because he missed his flight. Although I was not very close I tried to be a good person and loaned him about $400. He returned to the states however did not return to his job. He disconnected his phone, email, etc.. He does own a home and I think he is in the middle of attempting to sell it. In Alabama, am I able to file a lien against his property and if so, how would I go about it?

Re: Loan not repaid...

Under the facts you present, you cannot file a lien or take any other action to execute on your co-worker's property to collect the debt until a judgement is entered in your favor against your co-worker. You may want to file a suit in Small Claims Court in the county where your co-worker resides. If you obtain a judgment you can then exercise your remedies to execute against his property, etc. to collect on the judgment.
