Legal Question in Credit and Debt Law in Alabama

Personal Loan from now deceased

I was given ($2,500) from someone who is now deceased. There was no promissary note written, nor was the word ''loan'' written on the check. I am now being sued by the estate. Am I legally obligated to pay this money to the estate? If not, what is my defense?

Re: Personal Loan from now deceased

Did you ever pay any of the loan back? If not, you could say it was a gift. How does the estate know about it to begin with?
