Legal Question in Criminal Law in Alabama

Firearm

My aunt pulled a loaded gun on my mom in a public hospital in the room with my granny, b/c of a personal dispute. My mom pressed charges and issued a warrant, what legal consequences will my aunt suffer? I also want to what legal actions should be pursued by the hospital?

Re: Firearm

Your question does not say what charge or charges were filed against your aunt, but my guess is that she was charged with menacing or with reckless endangerment. Each of those charges is a Class A misdemeanor, carrying up to a year in the county jail. If the arrest was by the city rather than the county, the maximum sentence may only be six month, because some cities set that as their maximum sentence. If the warrant was issued for a felony charge such as attempted murder, then of course the consequences could be much more severe.

That said, it is also possible that your aunt could receive a shorter sentence, a split sentence, or probation when she goes to court. It will all depend on the details of what happened, her criminal history, how aggressively your mom and grandmother are pushing the prosecutors to punish her, and whether she has a good lawyer when she goes to court.

The hospital will probably obtain a restraining order to prevent your aunt from ever coming to the hospital again. Even if they do not get a court order, I am sure they will give her notification that she is prohibited from coming on the premises. If she went back there anyway, then she could be arrested for trespassing.

Good luck to you. If our firm can be of assistance to you in the future, please let us know.
