Legal Question in Criminal Law in Alabama
theft
Afriend of mine has been accused of theft by unlawful taking i the amount of $20,000, what I'm wondering is if with her never being in touble before, what are te chances of her getting probation, and not having to serve any time.

Re: theft
a "first time" ofender is more eligible for probation, etc., but this depends upon the Court's attitude toward the theft; how aggresive the prosecutor is and how much the victim wants to push the conviction. Your local counsel is in the best position to judge and advise his/her client on this. I have encountered judges and prosecutors who have felt that there was no excuse for a theft and would not probate under any circumstances.
