Legal Question in Education Law in Alabama

special education rights

My son was in special education from 1994-1998 in 98 we took him out of it. Now they want to put him back in.He is making passing grades. He tests below grade level in reading but we feel he will do better and learn more if he stays in regular classes. Please email with any help. Thank You

Re: special education rights

Sounds like there may be more to this story. However, for your information, the

Federal Law that governs special education (the Individuals with Disabilities Education Act, IDEA)

provides that a child cannot be placed in special education without a parent's consent. I must say

it's very unusual for a School District to offer services if a child doesn't need them.

But, I guess stranger things have happened. I usually represent parents that want services

and the District is denying them!
