Legal Question in Family Law in Alabama

Child Custody

I have full custody of my 5yr old son. Saturday, June 20, I was arrested for possession of drug paraphanellia. Monday June 22 my ex-husband filed for temporary custody of my son. Tuesday I was released from jail with time served. No fine, no probation, no future court date. It was my first offense. Is there any way to cancel the temporay custody? If so, what do I need to do?

Re: Child Custody

You need to get a lawyer to file a petition to set aside the temporary custody order. My guess is that your ex is going to use this as an opportunity to pursue full custody of your child, so you need to be getting ready for a custody battle. You may be facing a hard fight over the next few weeks or months. Go see a lawyer immediately and get him or her working on your behalf as soon as possible. Otherwise, you may find yourself paying child support to your ex-husband and only seeing your child every couple of weekends.

Our firm handles cases of this nature, and we will be glad to discuss it with you. Please feel free to call our 800 number and press 1 to reach my direct extension, or contact me online through this website or through www.williampfeifer.com.
