custody

i have a son in iraq who needs a lawyer when he gets home, his dad has temp custody of his and his x has vistation rights custody will be determined when he returns but his dad and step mother is trying to get a court order that he can't get the kids where does he stand and how can i help him

If his father is trying to take permanent custody of the children, then your son will need to get a lawyer involved as soon as possible. Your son has a prima facie right of custody to his children, and his parents will have to present strong evidence against him to keep his children. Unfortunately, these kinds of cases are usually very bitter and divisive, and your son needs to get ready for a nasty court battle.

You are doing the right thing by looking for an attorney for your son now, before he gets back from Iraq. I would suggest that you retain an attorney for him as soon as possible, so that the attorney can begin building a case for your son to get his children back as soon as he gets home. The attorney may also want to use a private investigator to secure additional information to use on your son's behalf, and you should be assembling a list of witnesses who can testify on your son's behalf.
