Just because she is suing does not mean she is going to win. Your son, if he currently has custody rights, can defend his rights in the suit. In fact, if he currently only has limited custodial or visitation rights, he can counterclaim for outright custody of the girl. What it ultimately means depends on what the judge decides, unless they settle the matter before it goes to trial. It may mean that he gets primary custody and the mom pays him child support. It may mean that he gets a really bad deal with very little visitation and a high child support obligation deducted from his paycheck every month. What happens will depend mostly on how he pursues his rights from here on out. Best of Luck.
