Giving up Parental rights...

My husband is now strongly considering giving up his parental rights to his daughter (12). He feels that she would much rather be with her step father than with him. They dont have a bond and as far as I know never have had one between them and its been like 2 months since they have seen each other or spoken. Neither seem to really care either way if they are in contact or not. SADLY!!!

Question...If he gave up all of his parental rights How would this affect the back child support and current if he gives up all of his rights?

A person does not just give up their parental rights, there has to be an adoption by the stepfather. It does not affect arrears but there would be no current child support. It would be gone.

I agree with Mari. My research indicates that your ex-husband has no standing to give up his parental rights. He was vested with the responsibility of parenthood the day your daughter was born. That responsibility can be taken away by a third party, but it can't be dropped at his option.
