Legal Question in Family Law in Alabama

grandparents rights

What are a grandparent's rights to see a grandchild if there is no divorce but mother and step-father will not let grandparent see child? (Step-father is not adoptive father and natural father is deceased)

Re: grandparents rights

Alabama has a grandparent visitation statute, but the results have been mixed, and the U.S. Supreme

Court has greatly reduced potential grandparent rights with a case this last June, though the basic Alabama law should be ok.

If you are the paternal grandparents then you have an excellent chance of getting some court ordered visitation. If, however it is your daughter who is denying you visitation, then it may be difficult to win visitation in Court.
