Legal Question in Family Law in Alabama

ok this might be a little lengthy. ok here goes. before my husband and i got married he and his girlfriend had a baby and he was granted full legal custody because the state said she was unfit to be a mother. then he joined the army and had to sign over custody to his mother, because you can't join the military as a single parent. the baby was taken away from his mother jan. 2010 and placed temporarely in the babys mothers home without my husband being informed about anything that was happening. court hearing in august gave custody back to the babys mother. now the mother is wanting child support, and husband has no problem paying that, but is he going to have visitation rights? should he be responsible for that since he signed over custody? why wasn't he informed about what was going on in jan.? he is now married to me and we want custody of her back. is that possible. thanks for all of your help!

He has a right to have notice. Now custody may be awarded in an emergency situation when they can not get in contact with him. why was custody taken from his mother. Did she attempt to fight it. there are many questions and you need a good lawyer to assure he has due process. and, since he is now married to you and both of you want the child, why did he not go back and try getting custody before this occurred. Many questions which need answering and you need a good lawyer.
