Legal Question in Family Law in Alabama

living situation

My sister passed away leaving 2 little children. My sister was not married to this man, ever! This man lives off of the childrens Social Security check. Approx. $1400.00 ea. mth) The childrens grandparents took the father to court and the grandparents(our parents) settled out of court. He keeps the money and the grandparents have custody. The father can get the children every other weekend and on Wednesdays. He has not exercised this right for sixteen months. One child lives with me(their aunt) and the oldest lives with the other aunt. They go to the same school and see one another on a regular basis. They know their brother and sister. They are at the grandparents home every weekend together. Now, the father is taking us back to court. Is it okay that they live with their aunt and uncle during the school year and are with their grandparents in the summer and when the school has holidays????

There are remedies but you could not do it without a lawyer. You must consult a lawyer. I am sure taking it back to court would get the kids and the checks. He also has to do an accounting of the money that he has spent.
