Legal Question in Family Law in Alabama

Modification to Child Support

My wifes divorce was settled in TN. That was 7 years ago. She asked for a modification to child support. TN told her to contact AL where we live now. He EX is in NY and they held the hearing with no change to child support even though he makes over double the salary now. Is this right or should it be TN or AL hold the hearing?

Re: Modification to Child Support

Did you respond to the complaint in New York or even have a lawyer there? If you did, then you consented to New York having jurisdiction. Usually when the parties move, it can be in either state where they reside if the other party agrees but most often in the state where residence is established for the child.
