Mother's rights of custody

I have a one year old whom I was never married to the father. The father has had nothing to do with us except give us a check every month. He did not even want his name on the birth certificate. I married shortly after the baby's birth and I would very much like to give custody rights to my husband. When I spoke to the father about this, he refused even though my son doesn't even know who he is. What can we do?

if the father's whereabouts are known an adoption must be done by consent. the natural father must give is consent in court for the adoption to take place.
