Legal Question in Family Law in Alabama

How to secure rights for my daughter.

My fiance is divorced from the father of our daughter. Before the divorce, they were seperated for nearly seven years. We plan to marry as soon as she receives an anulment.

I raised our daughter from birth, and she doesn't know her biological father. I would like to know what rights I may have (before and after marriage), and if there is anything else that can be done to secure my position. Power of Attornies? Guardianship?

Any help is appreciated.

Your question is a little confusing but I think I got the gist of what you wanted to know. AFTER you are married to the child's mother, consider adopting her. You can do this because it sounds like the father "abandoned" the child under the law. You can't adopt her until you get married. Before the marriage, the only thing you can do is get the mother to give you a limited power of attorney so you can take the child to school, etc.

I have to tell you that the first part of your question does not make sense. You stated, "My fiance is divorced from the father of our daughter. Before the divorce, they were seperated for nearly seven years. We plan to marry as soon as she receives an anulment." Why would she need to receive an annulment if she is already divorced? Regardless, you really need to contact a local adoption lawyer to see how you can legally become the girl's father (assuming that is what you and your fiance want). Best of luck.
