Legal Question in Medical Leave in Alabama

Intent in relationship to three year stature of limitation

How is an employers intent demonstrated when an employee looses his job for trying to take medical leave. and attempts to cover the deed up by forging the employees name to companys leave plan.refer me to simular cases if any.

OK, you've left out a lot of detail necessary to answer your question. Like what happened? Did you get fired while taking time off for a pregnancy? If so, that's a doozy, and I hope you call me right away. However, FMLA is not a general sick leave policy. If you are ill with the flu and need to take a little time off than you are not covered. Also, the company's leave plan is irrelevant. The company's plan must comply with the FMLA and thus whether you signed it or not is generally irrelevant. Although if your name was forged to some document, then it could certainly bolster your claim.
