Breach of Contract

My mother was a photographer and hasn't worked as a photographer since 2006. She began showing symptoms of schizophrenia in late 2006, early 2007. I received a letter from an atty yesterday stating that my mother had not provided wedding photos for a client she worked for in September 2006. My mother is on medication, has no recall, and is not stabilized, really yet. Her computer and cameras, etc. were sold to help pay for her medications. She is on disability (social security) and is on medicare. She will never be able to work again. How should I respond? I have just 20 days from Feb. 24, 2009 I am a student and have no money, this has been hard on my family and we don't need anymore problems. We have our hands full trying to help my mother with her medications, doctors and keeping her on an ''even'' mindset so she can not relapse.

As far as having 20 days to respond, is that the demand in the letter? If so, I would search to see if the film can be found or check where she gets it developed to see if it is there. Also check for the film or negatives. If you can not find it, then inquire as to how much was paid and offer to refund it. If they choose to sue, then of course there is not much recourse as your mother would be incompetent to handle her affairs. It may be best if at this time you proceed to get a conservatorship or guardianship of her at this point and be ahead of anything.
