Counter Sue

I need information on how to sue someone that is suing me. I had a vehicle that was removed from me erroneously. CPS refused to listen or view any of my documentation that proved that I was paying on the vehicle. The attorney that CPS hired to accept the payments didn't send the payments during the course of 19 months therefore, leaving CPS to believe that I wasn't paying anything. Not until the car was removed the attorney handling the receipt of payments delivered the 19 months of payments. What are my rights How can I counter sue these guys as well as get the courts to throw out their case.

Well, first let me say that you might want to get a lawyer to handle this case since some of the things you want to do can be rather complicated. However, to answer your question, since you've already been sued, you would simply need to file what's called a counterclaim against CPS but also name the attorney as well so you can bring him in. As for getting rid of their case against you, there are avenues to do just that but I don't know if I could really explain all that in this space without confusing you and maybe sending you off in the wrong direction. I would suggest that you at least speak to a lawyer directly about this matter. Good luck!
