Traffic accident

I was in a traffic accident where the other driver ran the red light. I had some head and neck injuries and my vehicle was serverly damage.It was not enough to total the vehicle. Is the other driver insurance require to pay depreciation on my vehicle,because this realy kills any resell value of my vehicle. Also what should be the least amount i should settle for.

You may very well be entitled to collect for the dimunition in value of your vehicle. Whether you can, and the amount you may be entitled to, will depending on car itself, the amount of dmamge, the age and mileage of your car.

As to the amount you should look for from a settlement, that cannot be determined without a review of your specific facts,the extent of your injuries and your losses. Most insurers are quick to try to resolve cases for amounts less than the true value of the case, before the injured party has the opportunity to seek legal advice.

Are you entitled to damages for loss of value of your car. Yes. That is one of your economic losses.

As to how much the case is worth, there is no way to tell without looking at the medical records and bills, any loss of income evidence and the repair costs.

you are not likely to settle this by yourself and get a good settlement. you will need a lawyer who advises you as to the medical records which you need and who can go jaw to jaw with the lawyer at the insurance company. Then there is the matter of the insurance policy maximum and then another thing called stacking which is where there may be other insurance policies on other automobiles that can pay.
