Legal Question in Intellectual Property in Alabama

Multipart Trademark

I want to start an independent record label and later expand the business into video production. Is it possible to use parts of a single trademark for the two different branches of the company? For example, if I trademark ''Mighty Music and Media,'' can I use the terms ''Mighty Music'' and ''Mighty Media'' separately with trademark protection or must everything I do in either branch carry the full ''Mighty Music and Media'' name?

Re: Multipart Trademark

You probably want to either develop each brand as a separate but somewhat related mark, or put yourself under the "family of marks" concept where there is a common element that links the sub-brands (like Total, Corn Total, Total Raisin Bran).

Depending upon your specific circumstances, you may want to delay filing trademark applications until you have established the commercial viability of your venture.

You should consult with a lawyer about both of these issues.
