A copyright attorney will tell say, you need to get permission from the copyright holder (or licensee) of the song. The same applies to restaurants that play music. Some of them have licensed the rights (through BMI, etc.) to legally play the music. Others do not and take a chance they will not be caught. Consult with an attorney in your area for specific advice.
