Legal Question in Medical Malpractice in Alabama

In April 2009, I had a spinal fusion. I was fine and I had no pain until August 2009. My orthopaedic surgeon sent me to a pain management doctor. After realizing this doctor was doing nothing but giving me pain medications to mask an underlying problem, I decided to see a neurosurgeon. After undergoing a couple of epidural shots and a ct scan of my spine, it was during an office visit to discuss it's results on March 1, 2010 that one of the 4 screws that was put in in April had entirely gone through my vertebrae and I beleive this is a major contributing factor to my pain. which at times is very debilitating. The sharp point of the screw seems to effect my bowel functions also. The neurosurgeon wants to do surgery and replace them, as well as, implant more screws. Would the pain I am experiencing, the problems with my bowels and sometimes inability to walk without having severe pain constitute malpractice due to the screw penetrating my vertebrae?

This is the kind of question that would require a medical professional to determine as to whether it was improperly placed or had worked it's way into the condition causing your pain. What does your Doctor tell you? If it was done improperly, then of course you have a medical malpractice suit.
