Both your mom and her 3 year old son would have a claim. The child's claim would be for personal injuries. Treatment at the ER certainly shows some level of injury. Your mother too would have a claim, not only for personal injuries, but also for the mental distress of seeing her child injured given that she was in the "zone of danger." My advice to people who try to handle their own claims is would you fix your own car if you are not a mechanic? Or would you treat yourself if you were not a doctor? Of course not. Then, what makes you think you can handle a legal matter if you are not a lawyer? I think your mother and the 3 year old would be well served by hiring competent and experienced plaintiffs' counsel.
