Legal Question in Personal Injury in Alabama

My husband was burned in an industrial accident that covers over 65% of his body. I have been told that he can not sue his employer, that his injury will fall under workerman's comp. My question is: Can I sue his employer on behalf of myself and our three minor children for mental distress.

Typically any injury on the job must be handled under workers comp. Should the employer refuse to agree to workers comp, then you could pursue an action for damages. This would still be under the workers comp statute however.
