Fire Department taking my land

The Fire Department says I haven't pay my fire dues.

I have cancelled checks & sent them to them. They sent a certified letter & said I owe then aprox $700.

My question is , can they just take my land or will they have to proceed with court? { I hope court} so I can show how stupid thier clerk is.

I am not sure what state you are in. I always recommend that you talk with an attorney from your area. Each fire district is different depending on state and fire district by laws. Most of the time they simply record a lien against your property and do nothing. Then when you sell or refinance the lien shows up and you have to take some action.

However, I cannot guarantee you that they will not take action at this time. Again, each fire district is different. I feel like the thing to do is take your paperwork to them and sit down with the clerk. If they are still insisting that you owe money, ask to talk to the clerk's supervisor.

Sometimes a fire district also has special assessments. Even if you have paid all of your dues, they sometimes make an assessment for new equipment or unforeseen expenses. Please be sure that you don't owe something like that.

Go see them and don't just let this sit there. Try to understand what they are claiming and try to get them to understand your position.

If all fails, consult a local lawyer.
