Legal Question in Real Estate Law in Alabama

Real Estate & Power of Attorney between 2 states

A friend of mine who lives in Alabama, owns property in Nevada. He wants to give me Power of Attorney to rent/sell/lease/remodel/ (etc) (have unlimited access to that property only). Would he need a Limited Power of Attorney State specific form from Alabama Or Nevada?

I would suggest a Nevada one since that is where the property is located. You can obtain forms from findforms.com or Nevada Legal Forms in Las Vegas.

Nevada law requires only that the power of attorney be "shall be acknowledged, or proved and certified, and recorded as other conveyances whereby real property is conveyed or affected are required to be acknowledged, or proved and certified, and recorded."

In other words, either a Nevada form or an Alabama form will work if the form is notarized. In addition, most title companies require that the power of attorney list the specific address of the property for which the power of attorney is being granted.
