Legal Question in Sexual Harassment in Alabama

Sexual harassment over 300 days old turns into just plain and simple harassment

I have been employed for two years and was subject to nude pictures on my computer every morning when arriving to work, this started at the beginning of my employment. I took copies to the plant manager & asked for this to be stopped. I told the Sr. V. President about this and he did not believe this was happening, however the plant manger did tell him he had the evidence. Nothing was done. Since that time the man I made the complaint about has done stupid things to me like moving my chair every morning two and replacing it with another one. I leave work with panic attacks and physically sick from this man's behavior toward me. I am at the point of leaving my job. To top things off 2 weeks ago i was searching for a paper (per the Sr. V. President) on the Sr. V. President's desk and he had a nude picture that had been run off the internet. Does the latest picture found constitute sexual harassment? Do I have a case if I were to decide to file a law suit?

If the pictures were paper and taped to or propped up on your computer, then you have a case. If they were in digital form on your computer, just delete the picture and continue working.

The nude picture you found in the VP's office is

his business and not yours. You found it only

because you went looking for something instead

of waiting for him to return to his office and

asking him, then, if he had what you were looking

for. If you sue because of the VP's picture,

the company's counsel will say, "Good morning,

Ladies & Gentlemen, we're here today

because Ms. Jones is a snoop." You don't want to do that. If you sue, sue ONLY on the pictures pasted onto/taped to/propped up on your computer and the harassment about the chair. Don't warry about the 300 days.

Such conduct would be a "CONTINUING violation." Go to a local employment-law

attorney and show him or her your proof as to who left the pictures and moved the chair.
