Legal Question in Traffic Law in Alabama

Can parent cosigner on car loan reposess car in son's name

I co-signed the loan on my son's car. He lost his job and I have paid all 4 payments so far. I can not afford to keep this up. He (age 22) has moved out and is hiding from me. His name alone appears on the title as owner as I did not want to be liable for any accidents etc. he may have with the car. I know where he is parking the car and I have a set of keys. Can I legally reposess the car and sell it to pay off the debt?

When a cosigner makes payments he subrogates to the rights of the lender. You may be better off going through the courts and getting possession that way to avoid any mistakes.

I would agree with Mr. Johns, then after you gain legal possession of the vehicle you can do whatever you wish, a brief letter from an attorney to your son might do the trick as well.
