death with of a will

My stepfather died May 09, 2009 and he told his girlfriend and my sister he wanted me to have the house that I and my family live in and have lived there for 7years with him but I dont know what is going to happen everyone says it has to go to probate court? I was wondering can we still buy the home?

Probate Court is the court where wills are presented for authentication and where estates without wills are administered. Real estate generally has to pass through probate unless you were named on the title with your stepfather. You can certainly purchase the property from the Executor of the estate or from the Administrator if you want it, but there might be some will out there that actually gives you the estate.
