Legal Question in Wills and Trusts in Alabama

How do I Find Out

My grandmother just passed 10-8-00. She supposedly had insurance but when all came to be needed, my uncle says that there wasn't enough for her burial. Five years ago my grandfather passed and I do know that he had plenty of insurance and left it to her. I do not think that she went through all of her money and I'd like to know how I can find out if there is anything, where it is, and what I need to do to find out.

Someone will have to take out letters of administration and probate her estate. You may call the probate office in your county to see if this has been done. If not you will probably need legal assistance in this regard.

As for any insurance proceeds they would pass outside the estate. You will have to have a copy of the policy to see who is beneficiary.

If you need help please call. No charge for consultation

Re: How do I Find Out

Several questions need answered first: Did she have a will? If not, who are her potential heirs? Alabama law gives priority to certain individuals who wish to probate an estate when the deceased individual did not have a will - spouse, child, etc. The individual has 40 days to file for letters of administration, and the individual must live in the State of Alabama. Once you have letters of administration, you can try to have an accounting and determine what assets she had. Please call me if you have any further questions: (205) 254-3927 or (888) 295-7409.
