Personal Representive

The Personal Representive of my mothers estate is now deceased,and his daughter has taken the estate checkbook and other items pertaining to the estate. The will has been probated and I was to become the representive for the estate.How do I get my Property back?

You need (through an attorney who handles these matters) to file a Petition with the Probate Court notifying them that the original PR has passed away and petitioning for Letters of Administration for yourself as the alternate named in the Will.

This is an ideal example of why it pays to hire a knowledgable attorney. You could argue with the sister for months while the money is frittered away or you could hire an attorney who can straighten this out asap. Call around, ask around. Get a good probate attorney. It should not cost much.
